With the President’s decision published in the Official Gazette, “The Decision Regarding the Distribution of Coal for Heating Purposes for the 2023-2024 Academic Year to Schools and Institutions affiliated to the Ministry of National Education” entered into force.
Accordingly, a maximum of 500 thousand tons of coal will be distributed to schools and institutions in 81 provinces affiliated to the Ministry of National Education in the 2023-2024 academic year. In case of need, the total amount can be increased by the Ministry of Treasury and Finance upon the request of the Ministry of National Education.
The amount of coal to be distributed in each province and district will be determined by the Ministry of National Education, taking into account the number of classrooms in the schools and the climatic conditions of the region. The coals distributed will not be subject to any savings other than meeting the heating needs of the school or institution.
Provincial and district national education directorates will ensure that coal deliveries are made in line with the needs of schools. Within the scope of this decision, a protocol will be signed between the Ministry of National Education and TKİ on the coal shipments and the deadline plan to be made in the 2023-2024 academic year.
The coal to be sent by TKİ to the delivery points declared by the Ministry of National Education in the “CIF” sales principles will be transported under the responsibility of TKİ by means of transport to be determined according to the location of the delivery points.
The shipment schedule will be made in accordance with the determined deadline plan. Provincial and district national education directorates will take the necessary measures in this regard by complying with the deadline plan. In case of failure to comply with the deadline plan, the demands of the schools will be met according to the new shipment program to be prepared by TKİ within the means.
A protocol will be signed between TKİ and TCDD Taşımacılık AŞ.
It will be ensured that the coal to be distributed within the scope of this decision will be distributed with the most suitable means and at the lowest costs and will bring the least financial burden to the public.
In this context, a protocol will be signed with TKİ and the Republic of Turkey State Railways Transportation Corporation (TCDD Taşımacılık AŞ) on transportation, and priority will be given. TCDD Tasimacilik AS will take the necessary measures for the complete and timely delivery of the coals.
The distribution organization within the province and district will be carried out under the coordination of provincial and district national education directorates. TKİ will procure the coal to be distributed within the scope of this decision from its own production sites. Before the coals are shipped, their analyzes will be done in the accredited laboratories of TKİ.
In this direction, coals that comply with the criteria set in the “Regulation on Control of Air Pollution Resulting from Heating” will be shipped. It will be the responsibility of TKİ to ship the coals suitable for the quality. The results of the analysis made by TKİ will be delivered to the provincial and district national education directorates, and the coals received will not be re-analyzed.
Provincial and district national education directorates can be inspected by the Ministry of National Education within the scope of the provisions of this decision. The audits and the reports prepared as a result of the audit will be reported to the Ministry of Treasury and Finance. All information and documents related to the work and transactions will be kept for submission to assignment reviews or other audits.
Taxes and fees (including VAT) arising from coal delivery to schools and institutions will be paid by TKİ. In accordance with the criteria determined by the General Directorate of TKİ within the scope of the decision, the costs related to the coal to be delivered to schools and institutions according to the “CIF” sales principles will be considered as the assignment fee and will be paid to TKİ within the framework of Article 35 of the Decree Law No. 233.
The sales price to be determined for the coal obtained from the enterprises affiliated to TKİ and produced exclusively in the facilities of the institution and sent to the schools and institutions will be the weighted average sales price of the same product in the previous month on the basis of the enterprise for the identification of the institution.
The procedures and principles regarding the implementation of the decision will be determined by the protocol to be signed between the Ministry of National Education and TKI. The provisions of the decision will be implemented by the Minister of Treasury and Finance.
